These Terms & Conditions ("Terms") govern your participation in the Green SM Driver Partner Program ("Program") operated by PT XANHSM Green and Smart Mobility Pvt. Ltd. ("Green SM", "Company", "we", "us"). By submitting the registration form on this website, you agree to be bound by these Terms.
1. Eligibility
- You must be between 23 and 55 years of age at the time of application.
- You must hold a valid Commercial Driving Licence — LMV-TR (Light Motor Vehicle – Transport), PSV (Public Service Vehicle Badge), or IDP (International Driving Permit) — issued by a competent authority in India.
- You must have a clean driving record with no major traffic violations or criminal offences.
- You must be physically and mentally fit to operate a motor vehicle for extended periods.
- Preference is given to applicants with prior professional driving experience, though it is not mandatory.
2. Registration & Onboarding
- Submitting the online registration form constitutes an expression of interest, not a guarantee of selection.
- All applications are subject to document verification, a personal interview, and a practical driving test at our designated centres in Gurugram or Greater Noida.
- Green SM reserves the right to accept or reject any application at its sole discretion without assigning reasons.
- Selected candidates must complete the mandatory training and onboarding programme before they can begin accepting rides.
3. Driver Partner Relationship
- Driver Partners are independent contractors and not employees, agents, or franchisees of Green SM.
- Nothing in these Terms creates an employer-employee, partnership, or joint-venture relationship between you and Green SM.
- You are solely responsible for your own tax filings, statutory compliance, and any obligations arising under applicable labour and tax laws.
4. Vehicles & Equipment
- Green SM may provide access to brand-new 100% electric vehicles ("EVs") under a separate vehicle usage agreement.
- The Driver Partner must operate the assigned vehicle with due care and in compliance with all traffic laws and regulations.
- The Driver Partner is liable for any damage caused to the vehicle due to negligence, misuse, or violation of traffic rules.
- Vehicles must be returned in the condition received, subject to normal wear and tear, upon termination of the arrangement.
5. Earnings & Payments
- The earning potential of ₹50,000+ per month is an estimate based on full-time driving in the Gurugram/Noida region. Actual earnings depend on hours worked, location, rider demand, rider ratings, and applicable incentive schemes.
- Green SM does not guarantee any fixed or minimum income.
Incentive structures, bonus schemes, and reward programes are subject to change at any time. Changes will be communicated in advance where practicable.
- Payments are processed as per the payment schedule outlined during onboarding and may be subject to applicable deductions (platform fees, vehicle lease, insurance contributions, etc.).
6. Insurance & Safety
- Green SM provides health and life insurance coverage for active Driver Partners, subject to the terms and conditions of the insurance policy.
- Insurance coverage is valid only during active driving hours on the Green SM platform and may not extend to personal use of the vehicle.
- Driver Partners must comply with all safety guidelines, including wearing seat belts, maintaining speed limits, and following Green SM's standard operating procedures.
7. Code of Conduct
- Driver Partners must maintain professional behaviour with riders, other road users, and Green SM staff at all times.
- Discrimination, harassment, or abusive behaviour of any kind will result in immediate suspension or termination from the Program.
- Driving under the influence of alcohol, drugs, or any intoxicating substance is strictly prohibited and will result in immediate termination and reporting to the relevant authorities.
- Driver Partners must not tamper with, modify, or attempt to manipulate the Green SM application, GPS systems, or fare meters.
8. Ratings & Performance
- Driver Partners are rated by riders after each trip. Consistently low ratings may result in reduced ride assignments, suspension, or termination.
- Extra rewards and incentives based on 5-star ratings are subject to the specific terms of the applicable reward programme.
- Green SM reserves the right to modify rating thresholds and performance criteria at any time.
9. Suspension & Termination
- Green SM may suspend or terminate your participation in the Program at any time for violation of these Terms, safety concerns, rider complaints, or any other reason deemed appropriate.
- You may voluntarily withdraw from the Program by providing written notice. Any outstanding vehicle-related obligations must be settled before departure.
- Upon termination, all rights to use the Green SM platform, branding, and assigned vehicle (if applicable) cease immediately.
10. Intellectual Property
- The Green SM name, logo, branding, and all associated trademarks are the exclusive property of PT XANHSM Green and Smart Mobility Pvt. Ltd.
- Driver Partners may not use Green SM's intellectual property for any purpose other than as expressly authorised during their participation in the Program.
11. Limitation of Liability
- To the maximum extent permitted by law, Green SM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Program.
- Green SM's total liability in any matter related to the Program shall not exceed the fees paid to you in the thirty (30) days preceding the claim.
12. Dispute Resolution
- Any disputes arising from or in connection with these Terms shall first be resolved through good-faith negotiation.
- If the dispute cannot be resolved amicably, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Gurugram, Haryana, India.
- These Terms are governed by and construed in accordance with the laws of India. The courts of Gurugram, Haryana shall have exclusive jurisdiction.
13. Changes to These Terms
Green SM reserves the right to update or modify these Terms at any time. Material changes will be communicated through the Green SM app, email, or this website. Your continued participation in the Program after such changes constitutes acceptance of the revised Terms.
